| Authority of the Arbitrators |

| The authority of the Arbitrators sponsored by the CCR is created by a written agreement and is authorized by the Utah Arbitration Act (see UCA 78-31a). The arbitration clause in the BYU Student-Landlord Rental Agreement is the provision of a student rental contract by which BYU student-tenants and university-contracted landlords agree that their housing disputes arising in the future will be submitted to arbitration. |

| | For disputes outside the BYU Off-Campus Housing Program, contending parties must sign a submission agreement for arbitration. In effect, when parties agree to have their dispute arbitrated, they give jurisdiction and control of their dispute to the Arbitrator. The decision of the arbitrators is final and legally binding and may include an award to one party or the other, or a decision to deny all requested relief. The arbitrator may decline to enforce any provision or claim that is judged to be unfair or inequitable. |
